Join Myles Chingara and Nicholas Holland from Maples and Calder (Cayman) LLP for a thought-provoking session on the evolving landscape of discretionary trusts and the rights of their beneficiaries. Building on the influential scholarship of Prof. Lionel Smith and his concept of Massively Discretionary Trusts, the discussion will delve into some of the most significant questions shaping modern trust law.
Key topics include:
The role and entitlements of objects of discretionary trusts and powers.
The position of default beneficiaries—when their interests vest, their information rights, and whether they can invoke Saunders v Vautier to collapse the trust.
The viability of charitable purposes as ultimate default beneficiaries and their ability to prevent a resulting trust.
This session will provide valuable perspectives for practitioners, academics, and all those interested in the fundamental principles guiding the future of trust law.
